Michelle Lazur Studios Workshop Registration: Terms & Conditions
By attending one of our workshops you/your child are accepting certain risks. Your agreement of this form shall serve as a release of Michelle Lazur Studios liability and a complete assumption of all risks by you. In consideration of, and as part of the payment for your participation in a workshop at Michelle Lazur Studios, you are voluntarily releasing Michelle Lazur Studios, their employees, assigns, independent contractors, or anyone involved thereof, from any damages, liabilities, costs, injuries whether mental or physical, known or unknown, and by participating you agree to assume all risks whether known or unknown.
Cancellation or Change of a Workshop by Michelle Lazur Studios
While Michelle Lazur Studios will make every attempt to operate a workshop once confirmed, we do reserve the right to cancel or change a workshop at any time due to insufficient bookings and/or any reason beyond our control. In such a case, a full and immediate refund will be issued. If a workshop is cancelled due to inadequate enrollment, you are allowed the option to transfer your workshop credit to another workshop within 12 months. The financial liability of Michelle Lazur Studios shall be limited to the amount paid to Michelle Lazur Studios for the workshop only. We are not responsible for any additional expenses incurred by such participants. We reserve the right to refuse acceptance of any participant, for any reason, at any time.
Cancellation and Refund Policy
Cancellation fees are not transferable and no refunds are made for unused or missed portions or services of a workshop/trip for any reason whatsoever. No refunds of any fees will be offered after the workshop begins.
Michelle Lazur Studios is not responsible for cancellations due to medical emergencies. Michelle Lazur Studios is not responsible for reimbursement of non-refundable transportation in the event of a workshop cancellation. Please check on your workshop status before making travel arrangements.
We rely on your attendance to make important arrangements, so if for any reason you need to withdraw, please notify us in writing (email is okay). The date we receive your written notification will be used as the date you gave your notice to cancel, at which time one of the following fees could apply:
For general workshops taking place at Michelle Lazur Studios Staff
- 15 or more days notice prior to workshop start date will be subject to a $50 cancellation fee
- 14 or less days notice prior to workshop start date will be subject to a cancellation fee of 100% of the workshop price
- Michelle Lazur Studios reserves the right to cancel a reservation if full payment has not been received by 15 days before the start of the workshop
There are no exceptions to our Cancellation and Transfer Policy for our programs, inside or outside the continental U.S.
Arbitration
You agree to have any claim, controversy, or dispute relating to the enforcement or interpretation of this document or arising or relating to your registration, participation, or attendance at any Michelle Lazur Studios workshop, submitted to binding arbitration under the rules and regulations of the American Arbitration Association. The arbitration shall take place in Westmoreland County, Pennsylvania.
Use Likeness and Intellectual Property Rights
As this is a photography workshop, it is educational in nature and it is likely that your personality, photographs and images will be captured in the photographs of other workshop participants and/or Michelle Lazur Studios. By participating in the workshop, Michelle Lazur Studios will assume you agree to have your/your child’s picture taken and used by any other participant and/or Michelle Lazur Studios including in Michelle Lazur Studios’s promotional materials. Furthermore, you hereby agree to indemnify and hold harmless Michelle Lazur Studios for any claims arising out of any subject matter contained in any of your photographs, including any claims for violation of any and all intellectual property rights.
Third-Party Services
You agree to hold Michelle Lazur Studios harmless from and against any liability for injury, death, damage, loss, accident, delay or irregularity that might occur in connection with any services provided by third parties.
